DOL Adopts Two Significant Changes to ​“Modernize” Overtime

Partner Mark Konkel and associate Nicholas Kromka co-authored an article in the Employee Benefit Plan Review, discussing two recent changes to overtime laws by the Department of Labor. These changes expand the overtime exemption for commission-based retail and service workers. The article examines how the additional compensation is compatible with fluctuating workweek method of computing overtime.
