Bill Jackson Quoted on New Jersey’s Landmark PFAS Settlements

Partner Bill Jackson was quoted on the two precedent-setting PFAS settlements between the state of New Jersey and chemical manufacturers 3M and DuPont that were recently approved by a federal judge. Kelley Drye served as co-counsel for the State of New Jersey throughout the litigation, that resulted in $2.5 billion in settlements.

Bloomberg Law reported that this case will provide insight for other states in future litigation on PFAS, or ​“forever chemical,” matters. 

“We learned a tremendous amount by litigating these cases and obviously understanding what DuPont and 3M understood with respect to the risks of this chemistry,” said Bill. 

Bill also spoke to Law​.com about the settlements, noting that there is a large volume of pending litigation over PFAS. 

“The approval of these historic settlements establishes a legal framework and serves as a precedent to shape and resolve massive PFAS impacts and liabilities nationwide,” Bill told Law​.com. 

Inside EPA also featured the settlements in an article, noting that ​“the more than $2 billion settlement with DuPont and its spinoffs Chemours and Corteva is the largest environmental recovery by a single state, while the 3M settlement worth between $400 and $450 million is one of the biggest legal recoveries in New Jersey.”
