Barbara Hoey Featured in Law360 Article on Vaccine Bias Suit

Partner Barbara Hoey was quoted in a Law360 article examining a recent decision by the U.S. Court of Appeals for the Second Circuit affirming dismissal of a religious discrimination claim tied to a COVID-19 vaccine mandate.

The case, involving The Brooklyn Hospital Center, addressed whether an employer was required to accommodate an employee’s request for a religious exemption where state law mandated vaccination for healthcare workers without exceptions.

Barbara noted that ​“Once the plaintiff refused to accept the vaccination, he could not work. He simply could not work. The hospital’s focus in 2020, and always, has been supporting its employees and serving its patients and the rest of the community.”
