Advertisers Touting ESG Goals Should Keep An Eye On NAD


As more companies have started to develop environmental, social and governance goals and make claims about their progress toward achieving those goals, we’ve seen an uptick in lawsuits and other challenges questioning whether the companies can substantiate or prove those claims.

While many of these challenges target claims about past or present results that can be proven or disproven in most cases, other challenges target aspirational and forward-looking statements, which are inherently harder to prove or disprove.
