The article is a follow up to two previous reviews of U.S. v. DiCristina, in which Federal District Judge Jack B. Weinstein found that poker was not gambling because it is a game predominated by skill rather than chance, a decision later reversed by the U.S. 2nd Circuit Court of Appeals. The authors note that the chances are the Court will accept the case are slim, and a decision will likely be made in February 2014.
