“The FCC Open Internet Order” by partners Tom Cohen, Hank Kelly and Chip Yorkgitis was published in Metropolitan Corporate Counsel. The article outlines what companies need to know about Federal Communications Commission’s long-awaited 2015 Open Internet Order, which the Commission adopted on February 26, 2015, in a 3-2, party-line vote. In the update, Kelley Drye’s Communications group provided an overview of the Commission’s new rules specifically related to network neutrality. Second, they reviewed the Commission’s decision to reclassify BIAS as a “telecommunications service” under Title II, and the key Title II provisions and related regulations that will apply. And finally, they highlighted some of the next steps that the Commission envisions through further proceedings.
