The Challenges Presented by Parallel Investigations

Parallel investigations bring with them many complex issues for companies and their in-house counsel. The term “parallel investigations” refers to separate investigations being conducted by different state or federal government entities. This article discusses the challenges presenting by parallel investigations, including: (1) identifying circumstances where a parallel investigation may be possible; (2) identifying if a parallel investigation is actually occurring; (3) how to handle whistle-blowers; and (4) communicating effectively with government investigators. This article also touches on the sharing of investigatory records and information between criminal and civil investigating authorities.
