Partner John Villafranco co-authored the Metropolitan Corporate Counsel article, “Gain With Less Pain: Ending Your Competitor’s False Or Misleading Advertising Claims Without Having To Litigate.” The article discusses the process and certain benefits of filing complaints with the National Advertising Division (NAD) of the Council of Better Business Bureaus, which is a self-regulatory body that reviews national advertising to determine whether claims made in advertisements are adequately supported.
John explains that the NAD was formed to promote truthfulness in national advertising and operates by reviewing complaints that can be filed by competitors, consumers, or though the NAD’s own monitoring program. The process resembles a court proceeding in some ways, but offers the additional advantages of efficiency and widespread participation without the costs of litigation.
