Disability Law: ADA Amendments Broaden Protections for Employees

The article examined the ADA Amendment Act of 2008 (ADAAA) and the new regulations under the Family Medical Leave Act (FMLA). The article discussed the “new ‘flexible’ definition of a disability,” “major life activities,” and what courts may consider “mitigating measures.” It also provided guidelines for ADAAA and FMLA compliance, as well as implementing a reduction in force that will prevent lawsuits and liabilities.
