Partner John Villafranco appeared next to other thought leaders as a contributor in the Nutritional Outlook article “Dietary Supplement Industry Issues in 2015.” John outlined the debate within the Federal Trade Commission regarding the substantiation required to support health-related claims. He notes that, while Commissioners appear to agree that an order provision requiring randomized control trials (RCTs) may be necessary in some cases, the Commissioners’ support for such a provision varies by the type of product. He mentions that the landscape on this issue is changing, and since cases that focus on this issue are currently the subject of litigation and lobbying efforts, “we should expect continued development with regard to the substantiation standards for dietary supplements.”
