Partner John Villafranco co-authored the Nutritional Outlook article “Are Energy Drinks the New Tobacco?” The article discusses how legislators, regulators, and health authorities are seeking to change how the energy drink industry labels its products and advertises to minors. John and Kristi draw the comparison of this case to the Federal Trade Commission’s attempt to restrict tobacco advertising, specifically Joe Camel, in the late 1990s. The article argues that unless the FTC can show energy drink advertisements are directly responsible for energy drink-related injuries, a ban against these advertisements is very unlikely.
