A host of new rules affecting the nuts and bolts of practice in the Commercial Division of New York State Supreme Court, from jurisdictional requirements and motion practice to discovery and trials become effective December 1, 2015. The new rules are intended to promote increased efficiency in resolving the kinds of complex business disputes that are heard in the Commercial Division and address proportionality in discovery, procedures for obtaining the deposition of a corporation or other legal entity through its designated representatives, durational limitations on entity depositions, summary jury trials, jurisdictional limits, bookmarking of briefs, and a trio of recommended case management order forms.
