Scott Cargill represents liquidating trusts, creditors’ committees, investor groups, financial institutions, trade creditors, and debtors in complex Chapter 11 proceedings. He has gained a wealth of experience navigating complex insolvency issues and has been involved in some of the largest corporate restructuring cases in bankruptcy courts across the country.
Scott advises clients on complex restructuring issues, including the auction and sale of assets, safe harbor rights under the Bankruptcy Code, contested confirmation matters, preference and fraudulent transfer liability issues, and the intersection between bankruptcy law and federal securities litigation.
Scott frequently writes on insolvency and restructuring topics and his articles have been published by the American Bankruptcy Institute, Credit Research Foundation, and National Association of Credit Management.
Represented an institutional client in a Chapter 11 case involving a metals leasing facility that was negotiated with the debtors and became effective upon the debtors’ emergence from Chapter 11.
