Jenny Wainwright helps clients navigate the increasingly complex landscape where communications and privacy law intersect. She counsels companies on navigating federal and state communications regulations and represents them in proceedings before agencies including the FCC and FTC. Jenny also provides strategic guidance on TCPA compliance, helping clients navigate evolving rules around consent, disclosures, opt-outs, and risk mitigation to prevent potential violations and liability. Jenny regularly contributes to the firm’s updates on FCC actions and TCPA developments, helping clients make sense of emerging regulatory shifts through clear, practical analysis.

Prior to joining Kelley Drye, Jenny was a paralegal for the Division of Marketing Practices in the Bureau of Consumer Protection at the Federal Trade Commission.

Advised clients on categorizing campaigns as marketing or informational/transactional and developing compliant consent disclosures and operational workflows that balance engagement goals with legal risk.

Conducted internal legal reviews of calling and texting practices for a range of clients.

Drafted written policies memorializing clients’ outbound calling and texting practices.

Provided TCPA training to legal teams and business stakeholders.

Monitored litigation trends, key court decisions, and FCC actions to update clients on significant TCPA developments. 

Reviewed third-party service contracts related to calling or texting to evaluate and protect against potential TCPA liability.

Drafted advocacy comments on behalf of clients in numerous rulemaking proceedings before the FCC, including matters related to the TCPA and telecommunications infrastructure deployment. 

Negotiated informal resolutions of individual TCPA claims and related state analogues on behalf of clients.

Assisted an industry trade association to procure third party management service, including drafting a request for proposals, attending candidate presentations, and negotiating a complex services contract with the vendor.

Managed a large-scale electronic discovery database, document review and productions in connection with FCC review of a high-profile acquisition involving two telecommunications service providers.

Advised telecommunications carriers on compliance with requirements related to the Customer Proprietary Network Information rules, the TCPA, and the E-SIGN Act.

Prepared and reviewed privacy policies and terms and conditions for clients across multiple industries.

Performed regulatory due diligence for service providers in connection with mergers and acquisitions.

Supported clients involved in federal and state enforcement actions, administrative audits and investigations.

Served as alternate representative on the FCC’s Broadband Deployment Advisory Committee’s Model Code for States working group.
