Jenny Wainwright focuses her practice on federal and state regulatory and transactional matters involving communications service providers. Jenny represents individual service providers, trade associations and ad hoc coalitions on numerous proceedings before the FCC, FTC, and other agencies involving oversight and regulation of service providers, as well as deployment of telecommunications and broadband infrastructure. Jenny also advises clients on compliance with state and federal regulatory obligations applicable to providers of telecommunications services. Additionally, Jenny assists clients pursuing commercial transactions, mergers, and acquisitions, by performing regulatory due diligence, obtaining necessary approvals, and addressing impediments to the client’s goals and objectives.

Jenny first joined the firm as a paralegal in 2013, while attending the evening program at Catholic University’s Columbus School of Law, served as an associate in the Communications practice group from 2015-2018, and returned to the firm in 2023. Prior to joining Kelley Drye, Jenny was a paralegal for the Division of Marketing Practices in the Bureau of Consumer Protection at the Federal Trade Commission.

Assisted an industry trade association to procure third party management service, including drafting a request for proposals, attending candidate presentations, and negotiating a complex services contract with the vendor.

Managed a large-scale electronic discovery database, document review and productions in connection with FCC review of a high profile acquisition involving two telecommunications service providers.

Represented numerous service providers in the Lifeline Modernization rulemaking, including stakeholder engagement with the FCC, state regulators, other industry members, Civil Society and Congress.

Drafted advocacy comments on behalf of an industry association in proceedings involving deployment of telecommunications infrastructure, business data services, the Connect America Fund, and tech transitions.

Advised telecommunications carriers on compliance with requirements related to the Customer Proprietary Network Information rules, the Telephone Consumer Protection Act, and the E-SIGN Act.

Prepared and reviewed privacy policies and terms and conditions for telecommunications companies.

Prepared compliance plans and applications for eligible telecommunications carrier designation under the FCC’s Low Income (Lifeline) Program.

Performed regulatory due diligence for service providers in connection with mergers and acquisitions.

Supported clients in the context of federal and state enforcement actions, administrative audits and investigations.

Served as alternate representative on the FCC’s Broadband Deployment Advisory Committee’s Model Code for States working group.

Jennifer was recognized by the Fiber Broadband Association as a 2018 Photon Award winner.
