The New York Law Journal Mentions Partner Robert I. Steiner as Counsel to LabCorp in Drug Test Lawsuit
In the New York Law Journal article, “Circuit Certifies Question of Pilot’s Drug Test to NY,” partner Robert I. Steiner is noted as counsel to defendant Laboratory Corporation of America (LabCorp) in a lawsuit that is being reviewed by the New York Court of Appeals to decide whether the plaintiff has a cause of action under state law. The plaintiff, Fred Pasternack, alleged that LabCorp mishandled his drug test, causing him to lose his pilot’s license. In September 2014, Southern District Judge Paul Gardephe dismissed Pasternack’s complaint saying no private rights of action exist against a drug lab for violating federal rules governing drug testing.
