The Metropolitan Corporate Counsel Notes Dynamic Currency Conversion Win on Summary Judgment
The Metropolitan Corporate Counsel reported on Kelley Drye’s successful representation of Dynamic Currency Conversion, its president, David Nahor, and one of Dynamic’s employees, Mark Silverman. In April 2009, a trial court granted Kelley Drye’s motion for summary judgment and dismissed Monex Financial Service’s tortious interference with contract claims. The trial court held, “there is no evidence ... that Dynamic did anything to induce [the third party] not to comply with its obligations under the [contract] with the plaintiffs.”
On August 3, 2010, the New York Appellate Division, Second Department, affirmed the trail court’s decision and held that Monex failed to raise any trial issues of fact warranting a trial.
