Suden discussed the obligation of counsel to monitor the court docket, and not to rely on the court’s email notice of electronic filing, commonly referred to as a NEF. Mr. Suden provides guidance from a recent Federal Circuit decision in Two-Way Media LLc v. AT&T, Inc., regarding counsel’s failure to download and read the full text of orders issued in the case, regardless of the docket notice circulated electronically, as it could negatively impact a party’s substantive rights.
