Partner Gonzalo E. Mon was interviewed for the GC Agenda column of Practical Law The Journal about free-to-pay trials, such as those in which ​“web-based subscription services [are marketed] through free trials” that automatically become paid subscriptions. In addition to meeting adequate disclosure requirements regarding consumers’ consent for payments, the article recommends companies ​“avoid using pre-checked boxes to obtain consent for payments,” ​“clearly present key offer terms in a [manner] that will be readily apparent to consumers,” and ​“respond to repeated consumer complaints.”
