Partner Mike Coursey was quoted by Inside US-China Trade on a case involving glossy paper from China, which is under review by the US Department of Commerce. At issue is whether a delay in Commerce’s preliminary antidumping finding will affect a countervailing duty (“CVD”) case against the same imports. Mr. Coursey commented that, if a delay caused the provisional CVD to be in place for longer than the 4 months allowed under WTO rules, the United States would likely have to stop collecting the provisional duty until Commerce reached a final determination in the case.
