Partner Mark Konkel Quoted in Law360 Article on New Jersey’s New Wage Theft Law
Partner Mark Konkel was quoted in Law360’s August 14, 2019, article, “3 Pitfalls for Employers in NJ’s New Wage Theft Law.” The New Jersey bill, signed into law on August 6, 2019, by acting governor Sheila Oliver, increases potential damages awards and can include criminal penalties for business owners.
It is debatable how much this new law will affect businesses. In the article, Mark offered insight by reminding readers of New York and California’s similar wage law overhauls, which included some of the same mechanics. These changes didn’t lead to the wave of litigation some forecast, and New Jersey’s may not either, he said.
“The law is going to give potential claimants and plaintiffs’ attorneys a new set of options, but really I would think of them more as embellishments to the kinds of claims that you already see being brought,” Mark said. “It really is just another flavor of the same liability we’ve seen in the past.”
