New York Law Journal Mentions Partner Neil Merkl as Counsel to the New York Catholic Conference in “Aid-in-Dying” Case
Partner Neil Merkl was mentioned as counsel to the New York Catholic Conference in the New York Law Journal article “Panel Refuses to Legalize ‘Aid in Dying’ Procedures.” The New York Catholic Conference is one of ten organizations opposing the legalization of the “aid-in-dying” practice in state law. The case involved a group of plaintiffs composed of physicians, patients and advocates for the terminally ill, who sought a declaration that the ban on physician assisted suicide, which they call “aid-in-dying” violates the Equal Protection and Due Process Clauses of the State Constitution. The holding affirmed the dismissal of the case by Justice Joan Kenney, but modified it to declare that “NY Penal Law §§120.30 and 125.15 provide a valid statutory basis to prosecute licensed physicians who provide aid-in-dying.”
