New Jersey Law Journal Reports on Kelley Drye’s Successful Settlement of a Consumer Class Action Suit

A New Jersey U.S. District Judge approved the $3 million settlement of suits against the maker of anti-aging cream Hydroxatone on November 22nd, despite a vehement challenge to the settlement by an objector. The objector sought discovery materials from the related case, Sabol, and ended up filing the lone substantial objection—claiming that the litigation was worth upward of $300 million. But Judge McNulty certified the Sabol class and gave final approval to the settlement.

Michael C. Lynch, Chair of Kelley Drye & Warren’s litigation practice, is quoted in the New Jersey Law Journal article stating it is a very, very fair settlement” adding that the court, we think, got this exactly right.”
