Law360 Takes Note of Partner John E. Villfranco’s Study on the Relationship Between Advertising Self-regulation and Litigation
Partner John E. Villfranco’s recent study on the correlation between class action lawsuits and decisions rendered by the NAD was referenced in the Law360 article “Ad Industry Self-Regulator Expanding Outreach To FDA, EPA.” The article discusses how the Advertising Self-Regulatory Council is seeking to educate U.S. agencies about its mission and how it can assist regulators in policing deceptive marketing claims. One obstacle they face is that some companies may be reluctant to participate in self-regulation for fear of follow-on class actions. However, the study by Mr. Villafranco shows that the number of class actions caused by an NAD decision is actually quite low.
