Law360 Reports on Kelley Drye’s Class Action Victory for Take-Two Interactive Software
Partner Michael C. Lynch was mentioned in a Law360 article entitled “Take-Two Beats ‘Grand Theft Auto’ Online Delay Gripe.” Mr. Lynch represented Take-Two Interactive Software Inc. in a putative class action filed in California which claimed that, Take-Two, the makers of the video game “Grand Theft Auto V,” misled gamers by advertising online features that were not available on the day the game was launched. The article reports that Federal Judge Virginia A. Phillips granted Take-Two’s motion to dismiss the suit, noting that despite marketing the online mode, Take-Two never guaranteed a date by which this feature would be available, and thereby, Take-Two did not make any fraudulent, unfair or unlawful statements. Associate James B. Saylor was part of the litigation team.
