Kelley Drye was noted as counsel to Foot Locker in the Law360 article “Foot Locker Seeks To Exit Customer Info Collection Row.” The article reports that Foot Locker filed a motion to dismiss a putative class action filed in California’s federal court accusing it of illegally collecting and storing customers’ personal information after in-store checkouts, arguing that the complaint only shows the retailer asked for, but did not record, the personal identification information and that the suit doesn’t prove the retailer violated California’s Song-Beverly Credit Card Act.
