Partner Paul Rosenthal was quoted in the Law360 article “ITC Clears Way For Duties On Plastic Resin Producers.” The U.S. International Trade Commission has determined domestic producers are materially injured by imports of plastic resin commonly used to make soda and water bottles from Canada, China, India and Oman, clearing the way for customs authorities to begin collecting duties. The agencies launched their investigations in response to March 2015 petitions filed by DAK Americas LLC, M&G Chemicals and Nan Ya Plastics Corp. America. The petitioners are represented by Mr. Rosenthal, partner Kathleen W. Cannon, special counsel David C. Smith, and senior associates Grace W. Kim and Brooke M. Ringel. Mr. Rosenthal noted that the domestic industry was “extremely pleased” with the ITC’s determination. “We have maintained throughout this case that the skyrocketing volume of imports of PET resin from Canada, China, India and Oman has injured the domestic industry with aggressive, dumped and subsidized prices,” he said. “The domestic industry is extremely pleased that the commission agreed and that these importers will now be subject to the discipline of trade orders to offset these practices.”
