To Revive Mexican Duties.”  The article discusses the Federal Circuit appeal to overturn the findings of a U.S. International Trade Commission sunset review that in 2011 revoked anti-dumping duties on Mexican stainless steel sheet and strip.

Kelley Drye clients North American Stainless and Allegheny Ludlum Corp. told the appeals court that both the commission and the U.S. Court of International Trade — which affirmed the decision in November — had incorrectly concluded that domestic steel producers wouldn’t be harmed if the duties were lifted.

The companies believe the ITC erred by investigating only whether removing the anti-dumping duties would lead to a spike in Mexican imports — not whether the current level of imported steel was already high enough to hurt domestic producers.
