Kelley Drye clients North American Stainless and Allegheny Ludlum Corp. told the appeals court that both the commission and the U.S. Court of International Trade — which affirmed the decision in November — had incorrectly concluded that domestic steel producers wouldn’t be harmed if the duties were lifted.
The companies believe the ITC erred by investigating only whether removing the anti-dumping duties would lead to a spike in Mexican imports — not whether the current level of imported steel was already high enough to hurt domestic producers.
