Partner Tom Cohen was quoted in the Law360 article “4 Big Questions Dogging FCC’s Plan To ‘Unlock’ Set-Top Box.” Federal Communications Commission Chairman (FCC) Tom Wheeler has the backing of the White House and seems intent on advancing his plan to “unlock” the pay-TV set-top box this year, but experts said he is heading into an uphill battle fraught with complications that could still kill or overtake the proposal. Mr. Cohen, who represents the American Cable Association (ACA), said on behalf of the ACA that Congress’ statute doesn’t justify intrusive regulation and the FCC can’t force unbundling without facing trouble in the courts. He went to note that, “The FCC expects MVPDs to police their privacy statute. That is not a role for an MVPD to engage in even if they could.”
