Kelley Drye’s John Villafranco Featured in FTCWatch
The Supreme Court’s unanimous ruling in AMG Capital Management LLC v. FTC was the subject of a panel discussion during the ABA Spring Meeting, and a recent article in FTCWatch.
The high court ruled unanimously that the agency was improperly using Section 13(b) of the FTC Act to obtain retrospective relief. As a result, the agency has shown a willingness to adopt novel legal theories and bring cases that aren’t necessarily a “sure thing.”
“The FTC is more emboldened than I’ve ever seen,” said partner John Villafranco. “Chair [Lina] Khan is litigating on principle and quite willing to take risks.”
