Kelley Drye Represents Domestic Brass Sheet and Strip Producers in Trade Court Victory
The U.S. Court of International Trade issued a decision November 7, 2007, in favor of domestic brass sheet and strip producers represented by Kelley Drye. The case arose from a finding by the U.S. International Trade Commission in a “sunset review” of an antidumping duty order. Wieland-Werke, a German brass producer, challenged the Commission’s finding that imports of brass sheet and strip from Germany were likely to injure a U.S. industry if the order was revoked. Rejecting arguments by Wieland-Werke that the Commission must identify an economic rationale for such actions, the Court sustained the Commission’s finding in the domestic industry’s favor.
