Bill Jackson Featured in Law360 in Coverage of DuPont PFAS Trial

Kelley Drye partner and co-chair of the firm’s Environmental Law practice group, Bill Jackson, was featured in the Law360 article, “‘No Question’ DuPont Polluted Delaware River, NJ Court Told.” The article covers the closing arguments in a precedent-setting PFAS litigation brought by the State of New Jersey against E.I. du Pont de Nemours (“DuPont”).

In his closing statement, Bill emphasized the voluminous evidence” presented demonstrating the discharge of per- and polyfluoroalkyl substances (PFAS), or forever chemicals,” into the Delaware River, stating, There is no question PFAS were discharged into the Delaware River.”

The case is part of a series of bench trials to determine the liability of DuPont and its subsidiary, the Chemours Co., for the environmental contamination of their Chamber Works site. Bill and a team from Kelley Drye are representing the state in claims under the Spill Act, the Water Pollution Control Act, and other environmental statutes.

The sixth and final bench trial, concerning the state’s fraudulent transfer and Industrial Site Recovery Act claims against DuPont, is set to begin on June 30. This series of trials is poised to shape the landscape of PFAS litigation nationwide.
