Six months after Harvey Weinstein and already we have seen a sea change in the world of workplace harassment. Claims today are not necessarily defined by legal standards or limited by statutes of limitations; it may not be about “sex” or legally-defined “harassment” at all.
The #MeToo movement is here, it is now, and its impact is powerful. Employers need to know how to respond; when to investigate; who should conduct the investigation; how to handle the press; and how to handle possible crime in the workplace.
Doing an investigation correctly and with sensitivity is more important than ever, especially since doing one incorrectly can lead to new retaliation complaints.
