Special counsel Robert L. LeHane spoke on a panel that discussed “Creditors’ Perspectives on Distressed Retail” at the Distressed Retail Summit in New York on October 16, 2008. The panel presented asset-based and distressed mezzanine lenders, trade vendors, landlords, claims traders and bondholders’ viewpoints of the current distressed retail market. Mr. LeHane discussed the current retail environment from the landlord’s perspective and the impact of the 2005 changes to the Bankruptcy Code on recent retail bankruptcy cases. The panelists, also included a Managing Director from Crystal Capital Fund, LLC, Managing Director from Bank of America Retail Finance Group, and the Chief Risk Officer of GE Commercial Finance, also advised buyers on the key considerations they should keep in mind for successfully dealing with the different constituencies.
