Partner Ira Kasdan gave a presentation for the Alliance of Marine Mammal Parks & Aquarium (AAMPA). His presentation, “Animal Law Property Issues and the U.S. Constitution” discussed the details of the Nonhuman Rights Project, Inc. v. Breheny (A/K/A Happy the Elephant, Fifth Amendment “Takings Clause”) and ALDF v. Kelly (First Amendment “FREEDOM OF SPEECH”) cases. Ira and his team of Kelley Drye lawyers had submitted three amicus briefs on behalf of Protect the Harvest, the Alliance of Marine Mammal Parks & Aquariums, and other Firm clients in the Breheny case in support of the Bronx Zoo’s position – which was affirmed by the New York Court of Appeals – that Happy the Elephant was not a “person” for purposes of being “freed” under New York State’s habeas corpus common and statutory law.
