Marisa Lorenzo is a member of the Communications and Litigation practice groups. Marisa’s practice primarily focuses on the representation of communications service providers in litigation and enforcement matters.
Marisa works with clients to navigate through and beyond government investigations, FCC enforcement actions and civil disputes, including False Claim Acts cases brought under both federal and state law. She also represents clients in all phases of complex federal and state commercial litigation, including trials, appeals, arbitration and mediation proceedings. Marisa is skilled in establishing relationships of trust with the clients she serves, as well as their constituents and the regulators who have a direct impact on their businesses.
Marisa offers a proven ability to develop strategies to overcome difficult or precarious obstacles, particularly when it comes to internal and external investigations. In addition to her ability to understand and explain the applicable legal playing field, clients also depend on Marisa to de-escalate serious acrimony and/or contention. Marisa is forthright and clear with her clients about their position and viable paths to resolution. Representing a communications carrier in litigation in federal courts and in actions before state public utility commissions involving claims for breach of tariffs and breach of contract.
Represented communications carriers in an appeal of an FCC Order involving the federal Lifeline program before the Court of Appeals for the D.C. Circuit.
Assisted in representation of a communications carrier in a proceeding before the Michigan Public Service Commission involving breach of tariff and breach of contract claims.
Assisted in representation of an international telecommunications company in arbitration governed by Hong Kong law and the ICC Rules arising from a patent license agreement.
False Claims Act Defense
Member of the litigation team defending pharmaceutical manufacturers in numerous cases alleging Medicare and Medicaid fraud, including actions brought by the U.S. Department of Justice on behalf of the United States, Attorneys General of several states, and private class actions.
Assisted in representation of a consumer goods company in arbitration governed by New York law and the AAA Rules arising from a long-term license agreement.
Assisted in obtaining an injunction preventing the termination of a long-term license agreement in New York State Court pending arbitration.
Assisted in obtaining preliminary injunction freezing certain assets in the United States pending resolution of underlying international arbitration proceeding.
New York State and Federal Litigation
Member of a team that successfully opposed an application for discovery from a foreign sovereign pursuant to 28 U.S.C. § 1782.
Assisted in defense of a national medical testing laboratory in litigation involving allegations that the laboratory negligently failed to accurately diagnose the presence of cancer in the plaintiffs under New York Law.
Assisted in obtaining summary judgment in favor of a national medical testing laboratory in litigation involving allegations that the laboratory negligently failed to transmit laboratory test results under New York Law.
