Upcoming Bankruptcy Cycle – Remember 2007-2008?

2023 March Forum

March 13, 2023 from 1:15 pm to 2:00 pm (EDT)

After nearly two years of relative inactivity, rising interest rates, inflation and supply chain issues point to an upcoming bankruptcy cycle that could rival the 2007-2008 economic crisis.  In this seminar, we will explore how this cycle may differ from the past and discuss creditor strategies that are better suited to today’s chapter 11 landscape.   The discussion will include topics such as:

  • Expedited Chapter 11 process—the need for prepetition planning
  • Fighting for leverage—creditors’ committee influence and creditor involvement
  • Getting paid—503(b)(9) claims, critical vendor strategies, preference exposure
  • The rise of subchapter V—diminished creditor protections
