The data collection issue is already one that is drawing public scrutiny to “Pokemon Go.” Ms. Hutnik notes that it’s become a best practice in the app development industry to notify and seek user consent before accessing potentially sensitive or private information on their mobile devices, such as locations, contacts and photos. She also told Law360 that a big question developers may face is whether they are indeed collecting, using and disposing of personal information in the way they say they are.
