We work with clients to develop and implement internal compliance programs and advise on difficult issues of how and when potentially hazardous consumer products must be reported to the Consumer Product Safety Commission (CPSC). We assist brands in participating in voluntary and mandatory industry-wide standards and advocate on behalf of clients in connection with proposed changes in standards.
Potential product-safety issues often require immediate action. We respond quickly, with right-sized teams of attorneys drawn from multiple disciplines across the firm, to provide complete representation and resourceful, strategic counsel.
Our attorneys evaluate consumer incident reports, including those submitted to the CPSC SaferProducts.gov database and, in the event of a product recall, collaborate with clients and CPSC staff to develop and implement cost-effective communications programs to satisfy product liability concerns quickly. Throughout any evaluation of a potential safety issue, we provide effective defense strategies that protect corporate interests and preserve business momentum in case the CPSC initiates a civil penalty investigation regarding the timeliness of a section 15(b) or section 37 report to the CPSC.
Our Consumer Product Safety attorneys also collaborate with our International Trade group to advise on the impact of the information-sharing agreement between CPSC and U.S. Customs and Border Protection on the import and export of consumer products. They work to assist in compliance with procedures under this agreement and secure the release of goods that may be detained at the Commercial Targeting and Analysis Center.
