KELLI ORTEGA Associate
Kelli Ortega is an associate who focuses her practice on all aspects of intellectual property law, including trademark prosecution and enforcement, copyright, and trade dress.  Kelli provides intellectual property counselling and assists with managing worldwide intellectual property portfolios and related prosecution and enforcement matters for various brands in industries including entertainment, media, fashion and retail, and consumer products.

Kelli negotiates and prepares coexistence agreements, settlement agreements, license agreements, and related intellectual property agreements, and also handles all areas of domain name management and enforcement.  Her experience also includes the successful advocacy and resolution of inter partes proceedings before the U.S. Trademark Trial and Appeal Board (TTAB).  Kelli also obtains decisions on the merits in multiple WIPO Domain Dispute proceedings in favor of several different clients, holding that the domain names were registered in bad faith and must be transferred to our client.

Domain name monitoring and resolution of disputes through UDRP and ICANN Domain Dispute arbitration. Obtained favorable decisions resulting in the suspension and/or transfer of domain names from cybersquatters to trademark owners.

Assists with inter partes oppositions before the U.S. Trademark Trial and Appeal Board (TTAB) and equivalent authorities worldwide.

Assists with various trademark and copyright matters, including counseling clients in industries including entertainment, fashion and retail, luxury goods and consumer products.

Commercial Litigation

Member of the litigation team that successfully represented a national testing laboratory at the New York Court of Appeals, which answered two certified questions from the Second Circuit Court of Appeals concerning whether a duty of care was owed and whether a fraud claim was stated in favor of the laboratory.

Assisted in successful representation of medical group against application for preliminary injunction regarding group’s billing practices.

Assisted in representation of beverage importing company in commercial dispute concerning claims for unfair competition, tortious interference and breach of contract.
