Fanny Turcios focuses her practice on environmental and energy law, with an emphasis on complex litigation involving emerging contaminants, natural resource damages (“NRD”), and property disputes. She represents states, governmental agencies, and private entities in high-stakes matters involving PFAS and other hazardous substances, as well as traditional environmental claims under federal and state statutes.

In addition to her environmental work, Fanny represents clients in a variety of commercial and environmental disputes including matters involving business torts, contractual issues, product liability, and large-scale property damage claims. She has extensive experience preparing witnesses, managing complex discovery, and defending and taking depositions in both state and federal courts.

Prior to joining Kelley Drye, Fanny represented individuals and corporate entities in a broad range of litigation matters, including tort, premises liability, construction defect, commercial disputes, mass casualty, and labor and employment claims. She brings a comprehensive and strategic approach to complex disputes, leveraging her diverse experience to advocate effectively at every stage—from early case strategy and discovery planning to motion practice, depositions, and positioning cases for successful resolution at or before trial.

Represented the State of New Jersey in its landmark PFAS contamination case against DuPont involving decades of discharges from the Chambers Works site. Fanny successfully argued an oral motion defending the State’s deliberative process privilege assertions and supported trial preparation. After a month-long federal trial, DuPont and related companies agreed to a record-setting $2 billion settlement for remediation, restoration, and damages.

Represents the State of North Carolina in litigation against DuPont and Chemours over widespread PFAS and GenX discharges impacting the Cape Fear River and surrounding communities. Fanny has defended the State’s witnesses during depositions and contributes to expert discovery, motion practice, and trial preparation.

Represents the State of Maryland in litigation involving decades of PFOA discharges from Gore’s manufacturing facilities in Cecil County. As a member of the discovery team investigating more than 13 facilities, Fanny manages document discovery, coordinates expert analysis, and assists in developing litigation strategy as the State seeks to recover remediation costs, natural resource damages, and other relief.

Represented the State of Ohio and Ohio Attorney General Dave Yost in litigation against DuPont over the company’s decades-long discharge of PFOA from its Washington Works Plant in Parkersburg, West Virginia. Fanny took depositions in the matter and provided discovery support, assisted in expert preparation, and contributed to trial strategy.

Represents the State of Tennessee, Maryland, and North Carolina in statewide PFAS contamination cases involving aqueous film-forming foams (AFFF), industrial facilities, and consumer products.

Defends a national home developer in property damage claims by nearby property owners relating to drainage, sediment discharge and erosion and purported impacts on lake levels and property values. The matter involves a multidisciplinary team of experts addressing complex technical issues involving hydrology, engineering design, and property valuation.

Achieved a significant asylum victory for a Russian client fleeing persecution based on sexual orientation, anti-war views, and political dissent. Fanny led a four-hour merits hearing, conducting an extensive direct examination through a Russian interpreter, handling evidentiary issues, and delivering closing arguments. The client was granted asylum from the bench.

Defended a regional corporate client against product liability, trucking and transportation, and premises liability matters, handling all phases of litigation.
