In the January issue of E-Commerce and Law Policy, partner Gonzalo Mon discusses the growing frequency and cost of lawsuits involving unsolicited messages in  the U.S. portion of Hot Topic: Hopes for 2014.”  Gonzalo explains that while most marketers know they must get permission before sending text messages, the rules have become more difficult to follow now that the Federal Communications Commission (FCC) requires stricter regulations around consent. This gray area has led to many settlements, so clarification from the FCC, combined with common sense decisions from courts, could be very helpful.
