Partner Neil Merkl’s chapter on Social Media is a new subject added to the updated nine volume version of the well-known treatise, Commercial Litigation in New York State Courts, Fourth Edition (2015). The social media chapter has been garnering enthusiastic reaction from the legal press – as a “cutting-edge discussion of the evolving law of social media.” The chapter discusses social media’s use in the civil litigation process and the ethical boundaries governing its use, including how social media is relevant to investigating a case, disclosure, jury selection and the prosecution and defense of a civil case.
