Partner William A. Krohley was quoted in the Law360 article, “Bhopal Plaintiffs Seek To Revive Union Carbide Pollution Suit,” regarding plaintiffs’ attempts for the Second Circuit to revive a property damage class action, originally filed in 2014, against client Union Carbide Corp. for chemical pollution in India. A personal injury lawsuit filed by the same plaintiffs was rejected by the Second Circuit in 2013. “UCC was not responsible for the alleged pollution at the Bhopal plant,” Krohley said. “That exact question was answered by this court in [the personal injury case] ... The allegations in the two cases are identical.” Partner William C. Heck is also representing Union Carbide.
