Associate Kristi L. Wolff was quoted in the Law360 article “Delayed FDA Menu Labeling Rules Face Bumpy Road.” The article discusses the FDA’s Affordable Care Act-mandated rules to have restaurants and other food retailers post certain nutritional information at their place of business. The long-delayed rules have still yet to come out, and many expect that it will likely face challenges from certain food retailers such as convenience stores where compliance will be a cost burden. Ms. Wolff commented that the New York court's recent ruling tossing out the state's soda ban for being applied arbitrarily to some drinks or locations and not others could be weighing on the agency. “It probably caused them to take a second look and [ask], 'Is something that we have here ... arbitrary?'” Ms. Wolff said.
