Adams was quoted regarding the retailer’s ability to pursue derivative claims against the secured creditors in a challenge of liens held by prepetition lenders. In the Law360 article, “USA Discounters’ Creditors Can Pursue Challenge Of Liens,” Mr. Adams said he still hopes to negotiate a resolution to the tax return issue but wanted to be able to file a complaint if the talks don’t progress. With Judge Sontchi’s ruling on Tuesday, Mr. Adams said that now the committee wouldn’t need to come back to court to seek permission and standing to file its complaint.
