In the Law360 article, “NY Hospital Beats Breast Cancer Survivor's Bias Suit,” partner Barbara E. Hoey and associates Ana Y. Correa and John P.J. Mattiace are noted for achieving a summary judgement for Wyckoff Heights Medical Center after a three-year litigation. Plaintiff accused the medical center of firing her illegally for missing too many days after developing a chronic medical condition. U.S. District Judge Dora L. Irizarry, however, agreed with Kelley Drye’s defense on behalf of Wyckoff, saying “given the overwhelming evidence of plaintiff’s persistent, recurring, and un-remedied absenteeism between 2003 and 2011, the record is clear that plaintiff was unable to perform that essential job function.” Ms. Hoey remarked, “Judge Irizarry took the time to write a very thorough decision.”
