Lauri Mazzuchetti Quoted by Law360 on TCPA Constitutionality Challenges and Fourth Circuit’s Government-Backed Debt Collection Call Decision

Partner Lauri Mazzuchetti was quoted in the Law360 article “TCPA Constitutionality Fight Gains Steam with 4th Circ. Ruling.” The article discusses the Fourth Circuit’s unanimous decision in AAPC, Inc. v. FCC that a portion of the TCPA — one that exempted government-backed debt collection calls from the statute's general prohibition on robocalls to cellphones — violates the First Amendment's free speech clause. The ruling is expected to open the door to further TCPA litigation — and set up a possible split with with the Ninth Circuit, which is reviewing a similar dispute.

Lauri, appearing at a Federal Communications Bar Association seminar and quoted by Law360, called challenges to the constitutionality of the TCPA “a game changer," but added that the Fourth Circuit's ruling "was not a great decision for what is trying to be achieved across the board on that issue."
