The rollback of mask mandates across the country may be a welcome development for many, although some employers following suit could face disability bias claims from workers. Barbara Hoey
is quoted in a recent Law360
article discussing accommodation for workers with special situations.
Another accommodation businesses can grant workers is a remote work arrangement. "If that person is that vulnerable, then maybe it's better to have that person work from home and keep them 100% safe," Barbara Hoey said. But if the job can't be done from home, especially if it's a public-facing position, things can get tricky. Perhaps that hypothetical worker could be transferred to another position.
