After more than 35 years of practice focused on U.S. trade remedy counseling and litigation, particularly under the antidumping and countervailing duty laws, Alan Luberda recognizes that effective counsel requires more than a comprehensive knowledge of the laws that govern international trade. To help his clients gain and maintain a competitive advantage, Alan immerses himself in the details of the businesses at the center of his efforts. He learns the product characteristics, production processes, sales and marketing, market dynamics and business goals of the clients he serves. This approach enables him to craft compelling narratives that consistently lead to favorable results in contested matters, achieve successful advocacy in trade policy, and offer actionable guidance in navigating governmental investigations and enforcement actions.

Alan’s clients encompass a wide range of industries including base metals, industrial equipment, consumer goods, agricultural and chemical products. He represents businesses – from large multinational corporations to family-owned enterprises – as well as ad hoc coalitions and industry and trade associations, in international trade matters before the Department of Commerce, the U.S. International Trade Commission, the Office of the U.S. Trade Representative, the U.S. Department of State, the Department of Homeland Security (including Customs and Border Protection) and the U.S. Congress.

Alan handles matters involving antidumping, countervailing duty and safeguard, export control, and customs laws, earning a reputation for both his comprehensive substantive knowledge of the law and his appreciation of the complex financial, logistical, and operational realities involved in moving goods around the globe, including primary metals, chemicals, industrial and consumer products, energy infrastructure equipment, agricultural goods, and other products. His first-chair litigation experience and record of successful resolutions extend beyond administrative and regulatory bodies to matters before the Court of International Trade, the U.S. Court of Appeals for the Federal Circuit, and other federal courts.

Alan was former chair of the firm’s International Trade practice and former Managing Partner of the firm’s Washington, D.C., office.

Counseling and representing one of the largest domestic and international steel producers of carbon and alloy steel flat products in significant trade litigation matters covering a variety of flat-rolled steel products under the antidumping and countervailing duty laws.

Counseling and representing domestic producers of large power transformers in trade litigation and enforcement matters under the antidumping duty laws.

Counseling and representing the domestic graphite electrode products industry in antidumping and other trade-related matters.

Counseling and representing the domestic activated carbon products industry in antidumping and other trade-related matters.

Counseling and representing the carbon steel wire rod and downstream wire industries in antidumping, countervailing duty and safeguards investigations, and customs enforcement matters.

Serving as a member of a joint steel industry team training Bureau of Customs and Border Protection personnel in enforcement of trade laws.

Counseling and representing the Specialty Steel Industry of North America in antidumping, countervailing duty and safeguards proceedings involving imports of specialty steel products, including electrical steel, stainless steel coiled plate; stainless steel sheet and strip; stainless steel tubular products; stainless steel cut-to-length plate; and stainless steel bar, wire rod and wire products.

Counseling various domestic seamless and welded specialty steel pipe and tube producers in a variety of antidumping and countervailing duty cases involving imports of welded carbon steel standard pipe, line pipe, ornamental tubing and structural tubing; seamless carbon and alloy steel standard line and pressure pipe; oil country tubular goods; and welded and seamless stainless steel tubular products.

Counseling various domestic producers and importers of agricultural, chemical and manufactured products in antidumping, countervailing duty and other trade-related matters.

Counseling and representing a major international chemical/biological processing equipment manufacturer with multiple international and domestic locations in a voluntary self-disclosure and internal investigation of potential export control violations before the Department of State, Office of Foreign Assets Control of the Department of Treasury, and Bureau of Industry and Security of the Department of Commerce.

Counseling various clients on export controls, including embargoes, chemical/biological processing equipment controls, encryption controls and International Traffic in Arms Regulations (ITAR) controls.
