[**Connecticut’s ​“Shrinkflation” Legislation: Expanding State AG’s Price Gouging Authority for Shrinking Product Sizes**](https://communications.kelleydrye.com/e/8q0a9kihysqzuog)

As we’ve discussed previously, price gouging has been a focus [](https://communications.kelleydrye.com/e/8q0a9kihysqzuog)for enforcers in the past few years, and 2025 is proving no different. This week, Connecticut Attorney General William Tong joined the fray by proposing price gouging legislation that, if passed, would put a novel spin on his state’s continued fight against price gouging.

[**Massachusetts Secures Record Judgment Against Insurance Companies**](https://communications.kelleydrye.com/e/hmezlofiqjmwka)

On the brink of the new year, the Massachusetts Attorney General’s Office (MA AGO) secured a landmark $165 million judgment, including civil penalties and restitution, against three UnitedHealth insurance companies: HealthMarkets, Inc. and its subsidiaries; The Chesapeake Life Insurance Company; and HealthMarkets Insurance Agency Inc. (formerly known as Insphere Insurance Solutions, Inc.) (collectively Defendants). The Suffolk Superior Court found Defendants liable for violating a prior consent judgment and engaging in false and deceptive practices.

[**State AGs Double Down on DEI (and ESG)**](https://communications.kelleydrye.com/e/sre2johsjdigf0w)

In December, we covered the announcement by 11 Republican state AGs of an antitrust suit against investment companies related to coal companies and ESG goals led by Texas. With the new year and new administration, we have seen state AGs continue their actions combatting ESG and adding a new emphasis on DEI.

[**NY Court Stalls JBS Greenwashing Suit**](https://communications.kelleydrye.com/e/rsueovepmwt33da)

In 2023, NAD reviewed claims that JBS had made about its goal ​“to be net zero by 2040.” NAD determined that although the company had taken steps to reach the goal, those steps weren’t enough to support the claim. In 2024, the NY Attorney General filed a lawsuit against JBS under the same rationale. Two key questions in these (and other) cases are (1) whether claims about future goals can be actionable under the law and, if so, (2) how much support a company needs. The NY Supreme Court recently considered these during a hearing on the JBS suit.

[**The Biden CFPB’s Final Salvo: A Call for State Action**](https://communications.kelleydrye.com/e/vyew3ux3sywusaa)

In its final days under the Biden administration, Consumer Financial Protection Bureau called on states to step it up – following soon after Director Chopra’s December appearance at the NAAG Capital Forum. In a detailed report, the Bureau attempts to counter looming changes in federal consumer protection under the new Trump administration by providing a roadmap for states and private plaintiffs to take up the Biden administration’s key priorities. Junk fees and consumer data privacy were, of course, top-of-mind.

[**Washington AG’s Bark Has Some Bite**](https://communications.kelleydrye.com/e/dua48zgcsaygag)

On January 17, Washington Attorney General Nick Brown announced that his office had reached a resolution in its nearly two-year lawsuit against Puppyland, a local pet store that sells and provides financing for (you guessed it) puppies, for claims of unfair and deceptive practices in sales and marketing in violation of the state Consumer Protection Act (CPA). The AG’s Office and Puppyland have entered into a consent decree under which the company will pay $3.75 million by the end of June 2026 and will be subject to new requirements in how it markets and sells puppies in Washington.
